Question re: NYC DOE maternity leave

Can anyone clarify for me?

I am aware you need to use all the days in your bank and then can borrow up to 20 days. If I have iyh 10 days in my bank and will borrow 20, it comes out to exactly 6 weeks of work. I plan to iyh take of 3 months. So does that mean I get paid regular salary for the first 6 weeks?
And What happends for the remaining 6 weeks I plan to take off after the initial 6?
Do I get paid for those? Do I need to borrow more days?

LAST QUESTION- Do you go on disability and get paid those last 6 weeks (if you took off 3 months)? If so, how much is the typical check

I know they provide workshops which I will iyh attend but I am trying to plan in advance

if you borrow days you get your regular salary for the 6 weeks. You cannot also get disability for that time or the 6 weeks after. You cannot borrow days past the 6 weeks.
After that you are solely on a FMLA leave and maintain your health insurance but do not get any Payment.

As far as I know you can not go on disability for the remaining 6 weeks unless there would be a medical reason why you can't return to work. If you're just taking off the extra time because you want to spend it with your baby that does not make you "disabled" and you therefore cannot collect disability. It falls under the FMLA law which would entitle you to keep you health benefits, they need to keep a job for you but you do not get payed for this time. Also I don't know what you do for the DOE, teacher or therapist, but just as an FYI only teachers can borrow 20 days. Therapists (OT and PT) can only borrow 10 days and only if they've been working at least a full year.

One other point, and the information I got on this could be wrong and could be different for teachers and therapists as well, but I had been told that I couldn't collect disability even for the first 6 weeks of my maternity leave. Just something to look into and clarify. If anyone knows any different I would very much like to know and find out who to speak to regarding this so please post!

Maternity leave for a therapist is very confusing and make sure you do the steps correctly.

When borrowing days make sure you email cybershift and your payroll secretary. I did not and I was taken off payroll and never got the days.(It takes about 6 weeks to get back on payroll) You can only take disability I think if you are going to be 2 weeks off of payroll. I would call the union to clarify and you need to fill out forms for disability. Good luck.

Family & Medical Leave Act (FMLA) - Maternity Leave: 6-8 weeks post event

· You are entitled to 6-8 weeks of sick leave post delivery with health benefits (6 weeks for natural and 8 weeks for cesarean delivery). You must use your accrued sick time, known as your Cumulative Absence Reserve (CAR) to be paid during this time before coming off payroll. Administrative employees are entitled to borrow up to an additional 10 paid days. Details here:

Troubleshooting Maternity Leave:

I got paid even though it is past the 6-8 weeks of my maternity leave. What do I do?

Contact your school’s CFN human resources and payroll administrator, which can be found through talking to your principal or searching the DOE website. The will need to authorize the payroll administrator to rescind the paycheck. Do this as soon as possible, as the DOE can ask for the funds back with interest.

I am back from childcare leave and I am not yet on payroll. What should I do?

Your principal needs to add you to their Galaxy. If they are having difficulty, contact your CFN’s human resources and/or payroll administrator. You may need to provide them with the HR letter confirming your leave dates. Going in person to the Leaves Department at 65 Court St. may also be helpful.

I am due in June and want to take part of my FMLA-Childcare leave in September. Can I do that?

Yes. The 6-8 weeks of FMLA-Maternity leave is taken directly after birth. The remaining 4-6 weeks of FMLA-Childcare leave does not have to be taken in succession, provided your FMLA forms have been approved. More information about your FMLA rights can be found here:

Any other helpful things I should know?

Fill out all of your forms before you go on leave. Consider faxing all the paperwork in yourself to confirm it was sent. Spend your first day back from leave making sure you have all adminitstrative/payroll items settled. Are you on your principal’s Galaxy? If not, contact your principal and CFN. Are you in Cybershift? If not, have your payroll secretary e-mail Cybershift. Do you need to reapply for health benefits? Fill out the ERB Health Benefits Application. Other difficulties? Consider visiting the Leaves Department at 65 Court St. in person with your approval letters.
