Small claims court question

I hired a contractor from New Jersey to do work in my house. I gave him to much money up front and he stopped coming to the job. Is this matter a small claims court issue? Does the fact that his company is in New Jersey and I live in and the job was in New York complicate things? Any advice? ty

I would suggest going to a library and checking out a book on the topic.
I found the NOLO "Everybody's guide to small claims court" very helpful.

If you do sue him, go extremely prepared to court. You lose out big time if you don't have all reciepts, documents, contract, photos....

I believe small claims court is only for claims up to a certain amount, which varies by venue, but is usually around $3-5K. If your claim is in that range, it's a great option, but for more money, you may need to go to civil court, and possibly have the expense of a lawyer.

If a contractor is willing to walk away with her money, I doubt he'll care what the BBB thinks of him. I think legal hardball is the only way to get through to him.
