Hi I need some advice,
I get paid in cash from my job and now I am doing my tax return and my accountant needs a 1099 from my employer so I can get a refund from nys.
I don't think my employer will be happy that I will be asking for one but I just want to be educated why, like what are the ramifications for him if he gives me a 1099?
(I know what he is doing is illegal, I didn't know this when I got hired...)

He has to pay back taxes on your wages.

He may be fined for filing the 1099 late. No back taxes would be owed if he issues a 1099 to you (assuming no one challenges your classification as a independent contractor and not as an employee - filing a 1099 would not trigger that though).

Thanks mothers but I don't understand u seem to contradict each other, I am happy to pay taxes, but will my employer have to? ?
If he does he will probably tell me he not giving it to me

I made a mistake. I think I was referring to a W2.
You will have to pay taxes.

So just to clarify what effect would this have on my employer? Like would he give me a 1099 easily? (Why and why not?)
(I just want to be prepared before I ask him)
