I just read this article on Parshas Mishpatim (where the "eye for an eye" concept is brought down):

As he explains, the literal translation actually doesn't make sense because translating Torah she'bichsav cannot be done without taking into account the actual words used - and the context. That's what Torah she'b'al peh is for, they go hand in hand.
