Instead of returning it to Amazon, post a great review and contact the company that manufactures the helmet and let them know how it saved your son's life and how grateful you are.
They may want to send you a new helmet as a thank-you for your comments.

How does this justify anything? If you claim it's defective, you're outrightly lying. If you claim it's 'used' without reporting that it's been in an accident, you can literally be putting the next user in danger. There may be internal damage to the helmet that's invisible. If Amazon resells it as used item, it may not do its job for the next user.
If you think about it, the helmet saved your sons life. And what is your response? To take the damaged helmet and put an unassuming person in danger. How does that even make sense? If it's not good enough for your son to use, it's not good enough for ANY child to use.

The helmet is not defective at all BH! It worked perfectly. Your son used it, it is now unusable (think of it as a product that you've used up) and now it needs to be replaced.
This is like when people try returning empty containers of product to Sephora or Bath and Body Works. You've used it and it's empty. You clearly liked it and it worked as it was supposed to work.
Now you need to buy more of the item because you've run out of the item you had.

Look at the helmet as if it was a fire extinguisher. There was a small fire, you used the fire extinguisher, and it put out the fire. The bottle still looks new. Would you return it?
Yes it's annoying to need to buy another helmet. But firstly, it's far cheaper than ch"v the injury your child was saved from. Secondly insurance is likely to reimburse you for the new helmet. Thirdly a few dollars down here in this world are a lot less expensive than what your neshama would have to go through to deal with the lack of yashrus in returning it.

They don’t really check the items they just resell them. I once bought a broom and dust pan and it came with the dog hair the person had swept up. Another time I got used underwear. So if they were checking the packages well then that wouldn’t happen.

A helmet is only good for one incident and then it must be replaced.

The at-fault insurance will definitely reimburse you for the helmet. So no need to return it.
