I googled and from a legal perspective it looks like you're most likely correct. (I didn't check the OP's jurisdiction in particular.)
From a safety and halachic perspective, certainly it shouldn't be open to the general public. If neighbors will use a yard as cut-through without asking, what's going to stop them or their kids from treating the pool as a public one?

There is a fence around the pool and an automatic cover that gets closed every night. Safety is not the issue here.

You have the excuse of privacy. The longer you prolong action on your part, the worse the problem gets entrenched.
