Fmla vs sick time

I got injured at work. I asked to use my sick time so I can get paid. I have several weeks worth of sick / personal time. My workplace is insisting that use FMLA. But, then I do not get paid. What is the point of having sick time and accruing it, if can’t use it? Anyone know? I can’t seem to find info when I googled it.

Shouldn't you be eligible for workers comp if you are injured on the job?

Something doesn't sound right. Isnt Fmla to take care of sick family members?

Where do you work? I would call a lawyer before I agree to anything.

FMLA can be for yourself and others. But definitely discuss with a lawyer.

If you are in NY they legally need to have workers compensation which is insurance to cover any injuries at work. Any medical bills and loss of income should be covered by their policy. They probably don’t want you to use it so that their premium doesn’t go up but they are not allowed to do that. Insist on getting their workers comp info and file. If they give you any trouble then speak to a lawyer.

If you were injured at work then they are on the hook not only for your leave but also for medical costs. I agree with pp it sounds like your job is trying to mess you over and you need a lawyer.

FMLA can be and usually used with sick leave. I'm confused, of course you should get paid with sick time when out on FMLA . They run concurrently.
