America has legal procedures. If his attorneys haven't filed for clemency, then what exactly are you asking? Your question is why didn't Obama break all precedent and violate procedure to (possibly illegally, if a filing is required) pardon a man whose at the center of a case that is near and dear to your heart?
On another note, while it's very possible that Obama has heard of the Rubashkin case, he's also probably heard about hundreds of cases that took place this year alone. America is a gigantic country with many cases, and many people going to prison for many years. Why would you assume that Rubashkin's case would be more noteworthy to the US president than the hundreds of other cases?

Perhaps Im wrong but I think the Rubashkin case made more headlines than most.

It doesn't matter if Obama has heard of it or not. If Rubashkin has not petitioned for clemency, he will not get it, end of story. That is how this works. As Marina pointed out, he's not on the denied application list, so he has not applied for it.

Gotya. Im sure his attorneys have a reason, this isnt just a plain omission on their part.
Anyhow we clearly have a blanked up miserable judicial system in place if buddies of the POTUS get away with lots of very serious stuff and hardly get jail time! But so what else is new?
