Pay for part time babysitter

I work part time and while I’m at work I hired a babysitter. She gets paid 15/hour. But when yom tov or a legal holiday falls on my work day so I have the day off, she gets a day off and doesn’t get paid. I thought that’s fair since I’m an independent contractor and don’t get paid when I don’t work. But she is complaining.

What do you think?

She's not an independent contractor.

That said - if she doesn't like the terms of her employment - she can leave.

Sit down with her and go over a calendar and show her how many paid working days she will have with you until the end of December - and let her decide if she wants to continue under your terms, or find a another job.

(Alternatively - come to an agreement).

This is the kind of thing you need to discuss before she starts working for you. Of course she's unhappy with lots of forced days off when she's not being paid. It sounds like she wouldn't have taken the job if she knew that condition.

We did discuss early on but now she decided it bothers her. It’s not so many days off just when YT or a legal holiday fell on one of my work days.

If she knew about it beforehand, you're in the clear. Although if your work day is a Monday, you're going to end up with lots of legal holidays. She can find another job if it bothers her.
