Do you live in a building or in an owner occupied multi-residential dwelling?
In the former, it would probably be considered discriminatory. In the latter, there are more liberal allowances when a landlord also occupies the same dwelling.

I am not sure if one can discriminate because of divorce, but there are a hundred different things one can say if they choose to.
I imagine one can choose to leave it unoccupied, let their relative live there, raise rent, complain about imaginary noise……
