Im not sure what the Halacha is about this and I was hoping someone here could help. We were at Dougies in Teaneck tonight and I noticed background music, specifically secular with instruments. I wasn't mad just surprised. Can someone explain?

We hold the restriction is on live music. Not applicable on muzak in supermarket or when your call to customer service is on hold, or someone on the train has polyphonic ringer tones.

just tonight I read that
-the music when on hold on the phone is ok

and

-if one is on a bus and hears music, one does not have to block one's ears.

but I dont know about a resteraunt.

then what about a mall?

according to Rabbi Shmuel Eliyahu (the chief rabbi of Tzfat, and son of R. Mordechai Eliyahu), the restriction only applies to intentionally listening to music, not background music that you didn't even turn on and such.
